Deery: Bill to uphold fair elections passes Senate unanimously

STATEHOUSE (Feb. 27, 2024) — A bill sponsored by State Sen. Spencer Deery (R-West Lafayette) that would require disclaimers on political communications generated by artificial intelligence (AI) unanimously passed the Senate today.

House Bill 1133 would create the expectation that if political campaigns attempt to influence an election using AI to create fake images, audio or video that are so realistic a reasonable person might not know they're fake, creators must label the content so voters know what's real and what's fabricated.

"We have already seen bad actors attempt to use AI-generated media to deceive voters in the 2024 presidential campaign," Deery said. "The technology is going to only get better and the threat to our elections will only grow more serious. It's important that we pass this bill this year before the May elections."

Without these guardrails, anyone could use AI to digitally alter someone's image or voice to create near-lifelike videos known as deepfakes and use them to attempt to deceive.

Under HB 1133, a candidate could bring a civil action against those responsible for generating AI content for campaign-related materials without a disclaimer.

"Voters have a right to know what's real and what's not, and House Bill 1133 will give voters another tool to decipher campaign messages," Deery said. "Ensuring candidates are honestly represented in advertisements is important in maintaining fair elections, and I believe this bill will help Indiana do just that."

The Senate amended HB 1133 and the bill will now return to the House of Representatives for further consideration.
