Messmer Report: Regulating third-party food delivery services

Regulating third-party food delivery services

By State Sen. Mark Messmer (R-Jasper)

In recent years, third-party food delivery services like Door Dash and Uber Eats have become a popular and convenient way for people to order food from a restaurant, especially when Indiana restaurants were forced to switch from in-person dining to take-out and delivery options.

This caused third-party food delivery services to increase in popularity as Hoosiers looked to support restaurants despite not being able to eat in person.

These new food delivery systems took advantage of the fact that there were no regulations in place to protect businesses and consumers.

In some cases, these services would deliver food from a restaurant to a customer without an agreement with the business.

This year, the Indiana General Assembly passed legislation that requires food delivery services to have an agreement with restaurants in order to transport their food.

House Enrolled Act 1279 allows restaurants without an agreement with a service to stop the service from delivering their food with a 72-hour notice.

This allows restaurants to manage who delivers their food and ensures drivers maintain important food standards to keep Hoosiers safe.

Another important part of this bill regulates the data collected by these delivery companies in order to keep Hoosiers' information safe and in the right hands.

The bill unanimously passed the General Assembly and will go into effect July 1.
